- Deposits – In England, it’s common for buyers to pay a 10% deposit when contracts are exchanged.
- Risk of damage – In both England and Scotland, the risk of damage to a property usually passes to the buyer when contracts are exchanged.
Scotland – Property law in Scotland differs from England and Wales in several ways:
- Landlord and Tenant Acts – The Landlord and Tenant Acts and the Law of Property Acts don’t apply in Scotland.
- Stamp duty land tax – Stamp duty land tax (SDLT) doesn’t apply in Scotland.
