Property Laws – Are property laws the same in the UK?

No, property laws are not the same across the United Kingdom.

England and Wales – Property law in England and Wales is generally similar, but there are some differences:

  • Land contracts – In England, land contracts often include the Standard Commercial Property Conditions, though these can be changed by the parties.
  • Deposits – In England, it’s common for buyers to pay a 10% deposit when contracts are exchanged.
  • Risk of damage – In both England and Scotland, the risk of damage to a property usually passes to the buyer when contracts are exchanged.

Scotland – Property law in Scotland differs from England and Wales in several ways:

  • Landlord and Tenant Acts – The Landlord and Tenant Acts and the Law of Property Acts don’t apply in Scotland.
  • Stamp duty land tax – Stamp duty land tax (SDLT) doesn’t apply in Scotland.
  • Offer to sell land – The Property Standardisation Group in Scotland has developed an industry standard offer to sell land.
  • Land registries – Scotland has its own land registry.
